Terms of Service

These Terms of Service ("Terms") govern your access to and use of DemonCheck ("the Service"), an uptime monitoring service available at demoncheck.com. By creating an account or using the Service, you agree to these Terms.

1. The Service

DemonCheck periodically checks the availability of URLs you configure and sends you notifications (via Telegram, email, or other supported channels) when their status changes. The Service is provided on an "as is" and "as available" basis.

2. Accounts

• You sign in using a third-party identity provider (Google, GitHub, Facebook, or Microsoft).
• You are responsible for all activity that occurs under your account.
• You must be at least 16 years old to use the Service.
• One person or legal entity may not maintain more than one free account.

3. Plans and Billing

• The Service offers a free plan and paid subscription plans with expanded limits.
• Payments are processed by our merchant of record. Prices are shown at checkout and billed on a recurring basis until cancelled.
• You can cancel your subscription at any time; cancellation takes effect at the end of the current billing period.
• Refunds are handled according to our Refund Policy.
• We may change plan pricing or limits at any time; changes apply from the next billing period.

4. Acceptable Use

You agree not to:

• Monitor URLs you do not own or lack permission to monitor, where such monitoring could constitute abuse;
• Use the Service to overload, attack, or disrupt third-party systems;
• Attempt to gain unauthorized access to the Service or its infrastructure;
• Resell or redistribute the Service without our written consent;
• Use the Service for any unlawful purpose.

We may suspend or terminate accounts that violate these rules.

5. No Guarantee of Alerts

While we strive for high reliability, we do not guarantee that every downtime event will be detected or that every notification will be delivered. The Service must not be used as the sole safety mechanism for systems where failure to receive an alert could cause damage, injury, or significant financial loss.

6. Limitation of Liability

To the maximum extent permitted by law, DemonCheck and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities, arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us in the 12 months preceding the claim.

7. Data

Our collection and use of personal data is described in the Privacy Policy. You retain ownership of the monitor configurations you create; you grant us the right to process them solely to provide the Service.

8. Termination

You may delete your account at any time by contacting support. We may suspend or terminate the Service or your account for violation of these Terms, with notice where reasonably possible. Upon termination, your data is deleted within 30 days.

9. Changes to These Terms

We may update these Terms from time to time. Material changes will be announced on the website or by email at least 14 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance.

10. Governing Law

These Terms are governed by the laws of the Republic of Moldova, without regard to conflict-of-law principles.
